Brexit Partnership Pact – preparing for changes at the UK border after a ‘no deal’ EU Exit. This provides Brexit information across a range of sectors including waste and will be updated regularly (page 99).
Notification recognition – the Competent Authorities in all Member States have been contacted by Defra/EA to obtain agreement that notifications in place on 31st October will be considered valid after that date in the event of no deal. All have agreed to roll over existing notifications from the 31st October. (update 7 July 2020 – Defra awaiting legal advice information will be available here and by communication to notification holders when known)
Should the UK leave the EU without an agreement in place on the 29 March then the Spanish Competent Authority for shipments of waste from the UK to Spain will become the Spanish Environment Ministry in Madrid on the 30 March.
While the UK remains part of the EU, and during any Implementation Period (if the Withdrawal Agreement is approved), notifications to ship waste to Spain will continue to be submitted by the relevant UK Competent Authority to the relevant regional Spanish Competent Authority.
Approvals granted by the regional Spanish Competent Authorities between now and 29 March will be “rolled over”.
The International Waste Shipments (Amendment) (EU Exit) Regulations 2018 – These apply the amendments necessary for the Transfrontier Waste Shipment Regulations 2007 to continue to be effective as explained in the Explanatory Memorandum.

HMRC – valuation of imported goods for customs purposes, vat and trade statistics
“(g) Goods (waste or scrap) imported for destruction in the EC, with the sender paying you for your services. As costs are incurred in connection with this destruction, the exporter would pay you an amount for your services. As you would not pay for the imported goods but, on the contrary, be paid for accepting and destroying them, no sale would have taken place.”
